Terms & Conditions

Effective Date: 2/18/2026

By enrolling in the Black Diamonds – New York Affiliate Program powered by GoAffPro, you agree to the following terms.

1. Enrollment & Approval

All affiliate applications are subject to review and approval. Black Diamonds – New York reserves the right to approve, reject, suspend, or terminate any affiliate account at our sole discretion.

2. Commission Structure

Commission rates are determined by:

  • Default commission settings
  • Commission rules (including order value thresholds)
  • Collection-specific rules
  • Individual affiliate overrides

Commission percentages may be modified at any time.

Commission is calculated on the final paid product subtotal only. Taxes, shipping, gift cards, store credits, and discounts are excluded.

3. Commission Approval & Payment

Commissions are subject to:

  • Order verification
  • Fraud review
  • Refund window clearance
  • Dispute or chargeback clearance

Black Diamonds – New York reserves the right to manually approve or deny commissions.

Commission payments will only be issued after the order is fully completed and outside of refund and dispute risk periods.

4. Refunds, Chargebacks & Disputes

If an order results in:

  • Refund (full or partial)
  • Chargeback
  • Fraud claim
  • Payment dispute
  • Unauthorized transaction

Any associated commission will be automatically reversed or withheld.

If a customer retains merchandise while a chargeback is active, commission will not be paid under any circumstances.

5. Custom Orders & Exclusions

Commission does not apply to:

  • Custom design invoices
  • VIP Custom Requests
  • VIP After-Sale invoices
  • Manual draft orders
  • Wholesale transactions
  • Orders flagged as high-risk by fraud screening

Black Diamonds – New York reserves the final determination of commission eligibility.

6. Self-Purchases & Abuse

Affiliates may not:

  • Purchase products through their own affiliate link
  • Use alternate emails or accounts to earn commission
  • Engage in fraudulent referrals
  • Use unauthorized discount codes
  • Misrepresent product materials or stone types
  • Bid on branded trademark terms in paid advertising

Violation will result in:

  • Immediate account termination
  • Forfeiture of unpaid commissions

7. Referral Tracking

Referrals are tracked via cookies and GoAffPro’s tracking system. Black Diamonds – New York is not responsible for:

  • Cookie blocking
  • Browser privacy settings
  • Ad blockers
  • Customer manually removing tracking codes

Last-click attribution applies unless otherwise stated.

8. High-Value Order Commission Rules

Orders above specific thresholds may be subject to reduced commission rates according to current commission rules set within GoAffPro.

Commission rules override default commission settings.

9. Brand & Marketing Conduct

Affiliates must:

  • Accurately represent Black Diamonds – New York products
  • Avoid misleading product claims
  • Use approved logos and materials
  • Maintain professional brand representation

We reserve the right to request removal of content that harms brand integrity.

10. Termination

Black Diamonds – New York may terminate affiliate participation at any time for:

  • Fraud
  • Policy violations
  • Brand misrepresentation
  • Inactivity
  • Abuse of the commission structure

Termination may result in forfeiture of unpaid commissions.

11. Modification of Terms

We reserve the right to update these terms at any time. Continued participation constitutes acceptance of revised terms.

12. Governing Law

These terms are governed by the laws of the State of New Jersey, United States.
